Subject: Reply to letter dated 9th September xxx

Dear Sir,

With reference to the above mentioned subject, as we are all well aware that the project, the client and the location is prestigious and  Jubilee project and we as xxx are the most suitable contractor under the gracious award of the project by the developer M/s. xxx.

To add we are delighted to be working for xxx consultants as well, it is equally important to our management to maintain the relationship, hence his visit to the site and discussion held.

In response to the points in your letter regarding our commitments on the project as well as our planned activities as discussed we are formally responding based on our conversation at site.

  1. Site Office: – We accept there was slight delay in getting the site office. However, please note that the site office has been installed within the mobilization period.
  2. Sign Board: – As per the site condition due to the space constraint we were not able to install the sign board as per the project requirement. However, as discussed with you that this is a temporary sign board and upon completion of shoring a proper sign board will be installed as per site feasibility.       
    1. BOQ copy & Contract Specifications: – was available on site.
    1. Substructure Submittals: – The submittals were done on 8th September xxx and most of the required submittals were approved by you and for the remaining we are arranging samples as required for your approval.
    1. Regarding the dewatering agency, please be informed that we are renegotiating with the subcontractors due the diesel price fluctuation and will be submitted for your approval before completion of shoring works.
    1. Regarding the steel shop drawings, we will submit the same as per the program. The program has been submitted on 10th September xxx for your review.
  • Work Program:- On 2nd September xxx, we had sent a letter by email requesting to finalize the commencement date which was confirmed during our site meeting on 8th Sept. xxx. The commencement date as agreed is 15th August xxx. The program has been submitted for your review and approval on 10th September xxx.
  • Guide wall inspection: – The setting out was done by our surveyor and was checked by us and found to be in line with the site requirement. The guide wall is a temporary structure and in the interest of work progress, the enabling works contractor procured ready-mix concrete from their regular concrete supplier. As the guide wall is a temporary structure meant to hold the shoring in line, regular shuttering which in par with industry practices were used. However, you concern has been noted and will be complied.
  • Regarding the two corner demarcation points, unfortunately it were destroyed during restricted machine movement. The same has been re-demarcated on 10th September xxx at the site for your reference.
  • With regard to the mid-day break UAE labor law, no works shall be carried out at the site which also applies to foreman and engineers. The authorities are on continuously patrolling this area and any violations will attract hefty fines. In the interest of all concerns and our company, we politely declined your request to take the measurement which was nearing the start of the mid-day break time. We regret if this action has offended you but our intentions were purely to protect our company’s interest by avoiding any fines or actions by authorities.
  • Site office Stationery: – Will be made available on the site on 13th September xxx.
  • Site Drawings: – Drawings are available at site.
  • Studying the Drawings: – MCM has done the site layout as per the approved DM drawings and the coordinates were as per the drawings. But in the meeting it was brought to our notice that in approved drawings allowance for guniting and waterproofing finishing were not considered and which will affect the internal clear dimensions in the basement. Hence, there was no discrepancy in understanding the drawings form our side and it was only discussion to arrive at a common solution to carry out the works.

We would like to assure you that, we are proactively involved and responsible to execute and handover the project within the agreed duration. As you are aware during the initial project start where we were facing issues obtaining NOC’s. MCM was deeply and continuously involved in obtaining the NOC’s along with the client’s’ office. This was our initiative to bring things in line with the client’s needs. This shows our commitment to the project and to all its concerned stakeholders.
