Dear Sir,
We are in receipt of your letter reference xxx dated 28 September xxx and we are writing to provide you the latest updates as officially received from each of the suppliers for tiles, sanitary wares and accessories.
- Tiles – M/s Home items
As per the latest update received from m/s Home Items on 29 September xxx (appendix 1), the tiles are expected to reach to Jebel Ali Port on 13 October xxx. The Shipment hasn’t yet moved from India’s Port despite being on the port since 20 September.
The planned date of 30 September xxx was mentioned in our tentative schedule based on the supplier’s earlier update which was conveyed to you as well via our letter ref (e) above that the materials will arrive by 3rd or 4th week of September xxx.
- WC & Washbasin – Duravit
As per the latest update received from m/s Duravit on 29 September xxx (appendix 2), the WC & Washbasins are expected to reach to Jebel Ali Port on 18 October xxx.
- Mixers, shower sets, shower arms, hand spray shattaf – VADO & EMPOLO
As per the latest update received from the supplier on 23 September xxx (appendix 3), partial delivery of the materials is expected to arrive to Jebel Ali Port on 25October xxx and the balance quantity is expected on 20 November xxx.
However the supplier is currently abstaining from providing any supportive shipping documents to validate these dates.
- Concealed cistern tank – SANIT
As per the arrival notice received from the supplier on 30 September xxx (appendix 4), the cisterns are expected to arrive to Jebel Ali Port on 13 October xxx.
All the delivery updates provided above are being shared with you in full transparency as received from the suppliers. Such delays due to vessels & shipments from overseas are beyond the control of M/s xxx (Contractor Name) and we urge you again to allow the submittal of local alternative material in order to mitigate any risk of delay.
As we have previously stated, we will continue to extend all possible support to the Contractor, including increasing our rate of pod production whenever possible to provide pods to your site in the shortest time frame possible once all material arrives. Nevertheless, we remind you again that you remain solely responsible for delaying the release of the Subcontract Agreement to a date almost two months beyond what is stipulated in your own baseline Programme.
M/s xxx (Contractor Name) has provided the Contractor numerous warnings prior to receiving the order on the risks associated with delaying the release of the Subcontract Agreement especially considering the origin of the procured materials and the current pandemic, and M/s xxx (Contractor Name) shall not hold any responsibility neither direct nor indirect for any delay to the project resulting from ASC own conscious actions.
