Subject :     Removal of materials to be used in xxx Phase 1.

Dear Sir,

We are writing to you following the receipt of the attached email (appendix 1) from xxx – Phase 1 BHC team instructing us to remove certain items from the pods delivered to your Phase 3 project and use them in the Phase 1 project as replacement for damaged materials on Phase 1 site.

Please note that if you accept to uninstall these items from Phase 3, you do so under your own responsibility. M/s xxx (Contractor Name) has already completed the Subcontract scope of Phase 3 by delivering this material as part of our Pods for your project, and shall not hold any liability neither direct nor indirect towards any delay which may occur to your project if the Phase 1 project fails to re-supply this material back to the Phase 3 project in time for final handing over.

M/s xxx (Contractor Name) will place orders with suppliers to procure again these materials for phase 1 upon receipt of an official approval of the submitted cost estimate. In the meantime, please note that these are long lead items which have to be procured from overseas and M/s xxx (Contractor Name) cannot give any guarantees on the date at which these items will be delivered to the Phase 1 site to then be forwarded to your Phase 3 site.

Accordingly, we need your formal confirmation and acceptance that M/s xxx (Contractor Name) are allowed to uninstall the requested materials from your phase 3 site under the full liability of BHC as noted above.

Your confirmation by return is appreciated to allow us to proceed with the received instruction.
