Dear Mr. Prince,

We are writing to respond to the letter ref. No. xxx dated 26 April xxx and your email dated 27 April xxx (appendix 1).

In relation to the comment related to the scope of Xxx which is reflected in point No. 2 of the Operator’s comments “Pod’s wall paint shall be white not gray” please note the following.

The paint color code approved and used in all the Pods is Jotun 9918. This color has been selected by the Engineer as noted in the Engineer’s comments recorded in the approved material submittal for paint No. xxx rev.01 (appendix 2). The description of the color code Jotun 9918 selected by the Engineer as per Jotun data sheet is “Classic White”.

Xxx have produced and delivered all the pods in full compliance with the approved material submittal for paint reference above. Additionally, all delivered pods have been inspected and approved by the Engineer based on the color code selection.

Should you wish to change the color code of the paint at this time, this will result in major abortive works on all 279 pods already delivered and installed on site. Such abortive works, if implemented, are not the responsibility Xxx and do not fall under our scope of works which has already been delivered and approved.

Additionally, please be advised that works of this magnitude cannot be performed by Xxx outside the factory. Consequently, if you chose to proceed at your own recourse and execute such abortive works on site, please note that you are advised to provide all necessary protection and take all necessary measures to avoid damages to the pod or to any of its components.

Xxx shall not be responsible neither directly or indirectly for any damages to the pods resulting from works being performed by the Contractor whether inside or outside the pod, including any damages resulting from abortive work you might perform to change the paint color.
