Dear Sir,
We are writing to inform you that production for all 3336 pods under the scope of our Sub-Contract Agreement ref: xxx has been completed since 02 January xxx.
From the 3336 completed pods, 3274 pods have already been delivered to site and 62 pods are ready and available in our factory awaiting your site to be ready for delivery.
Non-availability of free issue material by xxx
Please note that out of the 3336 completed PODs, 3274 have been delivered at the request of xxx without completing the installation of one or more Free Issue Material (Downlight, Spot light, Ablution Spray, Hand shower, Shower Mixer). This is due to the fact that xxx did not make available this material to Xxx prior to production and delivery in accordance with the agreed schedule.
Although Free Issue Material which is received after completion of production and delivery is post-installed by Xxx at site, Xxx will not be held responsible in any way, shape or form for any delay resulting from the non-availability of this material or any impact thereof on other site activities. Such delay is on the account of xxx.
Xxx will also not be responsible for any delay the lack of availability of Free Issue Materials may have on the final approval or handing over of the works.
The status of the Free Issue Material is being communicated to xxx on a regular basis. The current status is as per the following table where the balance material that has yet to be received from xxx is highlighted:

Xxx will resume the installation of the balance Free Issue Material on site once it is received, however we reserve our rights to claim for all additional cost incurred resulting from the additional work required to be performed out-of-factory to install your materials at site.
We further reserve our right to claim for an Extension of Time (EOT) as a consequence of the lack of availability of xxx’s Free Issue Material affecting completion of the works.
