nnnnDear Sir,
nnnnWith reference to above cited letters, we wish to put on record there has been a significant delay in nomination of provisional items and selection of Prime Cost Items. The delay in nomination and selection will affect the project critical path and delay the overall project completion. Following are the Provisional Sum items to be nominated by Client and Prime Cost Items list are attached.

Upon receipt of subcontractor/supplier nomination MCM will enter a subcontracting agreement/ issue LPO, the next step will be securing Engineer approval for shop drawing and materials. Once required approval are secured then only materials delivery lead time will be started. Depend upon selection of materials the lead time may vary 4 weeks to 14 weeks. Considering said scenario Provisional Sum and Prime cost subcontractor/supplier nomination are extreme critical at current stage to complete the project as agreed completion time.
nnnnThe Contractor reserve its right pursuant to Sub-Clause 6.3, 44.1(d) and 53.1 of Condition of contract to claim time and cost implication due to delay in nomination of provisional sum and prime cost subcontractor/supplier.
nnnnTherefore, we request your urgent intervention to address this matter by asking to the Client to finalize the pending nominations on top priority basis.
