Subject: Re: Notice of Delay
Dear Sir,
In response to your letter ref. xxx-14 dated xxx 2022, we thank you for notifying us for the delay. Rest assured we are not taking this matter lightly, be informed that we will be submitting the final drawings to your office on Friday morning, for your review and approval before submitting it to the DM. We request you to expedite the matter once received to support us come in line with our revised program.
To your second point about the time and cost implications, we are aware that we are responsible and would be held accountable contractually. Having said that, we will be submitting our revised program for the build duration after the submittal of final drawings to DM. The revised program would be incorporated in the overall duration of 11 months of design and build which is in our contract.
To keep you in light, the reason for this delay was due to a structural steel contractor who had mislead us about having all the documents to execute the work. They had almost all relevant document to work in other areas however, they had a missing BPS certificate that would allow them to use the DMs portal to submit the drawings. They had misled us about the BPS certificate and we had discovered this at a very late stage. So, we had to take legal actions to ensure no harm or impediments would arise to the project. In course which lead us to hire another steel subcontractor hence the lag in the submission.
We are hoping for your kind understanding and consideration regarding the said matter.
Yours Sincerely,
xxx Building Contracting LLC
