Subject           : Regarding intimation for the partition wall variation for time and cost

Dear Sir,

With reference to above and as per your letter ref no:AP/269/CC/224 dt.30.01.17 we are intimating for the variation for the time and cost and kindly note the following:

  1. We are attaching all the communication in summarized manner and the involvement of client within the communication protocol and outside discussion which is self-explanatory.

So we are not agree with your statement that “client have not instructed for higher STC value”.

  • Contractor does not had the Authority requirement for acoustic in rooms which was written in tender drawing for partition and we are attaching the summary for drawing, standard and specification for your review to establish our claim for variation for time and cost.
  • As the meeting held in consultant office in consultants presence on dated 08.01.17 that client representative instructed with comment along with the consciousness ,after having the call with Mr.Shailen verma with the competency .

              This is the ethical decision made by client representative (CR),  Contractor follow this with the effective manner  to support the project , since client representative has  decided infront of the consultant, contractor discussed  along with the supplier and  client representative need to honor his decision .

  • Contractor have the tender drawing which have the indicative value and the contract document general specification have the value with 45dB and client instructed  as per described above in item no.03 to proceed with 45dB .
  • We are also attaching the ASTM standard and the tolerance limit between the indicative value E90 and field test and contractor initial approval was based on the specification and standard.
  • We are attaching the document which are summarized and arranged in chronological order from 26.006.16 to 15.01.17 and we executed the mock up after approval of drawing on 26.01.17 and mock up room being constructed as per the final approved drawing as per client’s instruction.
  • We are attaching the claim for the variation  which includes the cost of AED 69963.30 and the variation in the time due to delay in the decision which took more than  200 days and the execution time already placed in our revised program R10(Extension need to be granted with cost variation as per clause 5.2,  44.1, 51.1, 52.1  & 53.1 (NOTICE FOR CLAIM)

So, kindly review all the documents which are self-explanatory as the  issue started on dated 26.06.16 till 15 .01.17 as well as still many items are pending from the employer till date and contractor will not held responsible for any further delay and decision to be taken prior to execute the work from 3rd floor for cost and time.
