Subject            :           xxx response against delay notice – fabrication, delivery and installation of pods.

Dear Mr. xxx,

We regret to receive again your letter ref: xxx dated 11th November xxx which we completely refute. We had once explained and demonstrated that there is absolutely no delay from xxx side so far in this project which is still valid and the same is attached with this letter for your reference (Refer to Appendix 1).

Regarding the delivery of pods in this project, we have never defaulted on deliveries so far what Mr. xxx had requested to us. Referring to the email attachment highlighted in your letter was not an updated log. This was only released on an urgency as requested by Mr. xxx. It was also communicated to him that an updated schedule will be send later that day 11.11.xxx. Please find the email send to Mr. xxx as promised for your quick reference (Refer to Appendix 2).

To prove that xxx have performed more than what had committed in this project Please see below figures as of 11.11.xxx,

  • Quantity of pods as per Unipods schedule 11.11.xx to site – 101 Pods
  • Quantity of pods actually received at site as per monitoring    – 122 Pods,

Please see attached Delivery Monitoring Report (Refer to Appendix 3).

Moreover we have around 29 pods ready in our factory stock waiting for your request on delivery. Based on the above facts we fail to understand how you can post a delay notice to xxx. So we appreciate if you can make necessary arrangements to take all the pods ready in Unipods factory at the earliest to avoid chocking our factory space.

We would like to highlight certain concerns which may have an impact on the schedule.

  1. We received an email from Mr. xxx for Room 58 L2-99 & Room 41 L2-82 on 11.11.xxx to change the drainage location which had put the casting on hold for a day.
  • Type 8 Pod Drawings are still not approved from your side which we submitted on 05.11.xxx.
  • Linear Drains revised quantity required before end of this week.
  • Free issue materials are not delivered to xxx as agreed so all pods delivered to site are with these missing materials.

Hope this is clear and would expect an appreciation on our support, hard work and cooperation we extent to this project.

This is for your information and record.

Yours faithfully,

On behalf of xxx LLC

xxx
