Dear Sir,

We acknowledge receipt of your letter reference xxx dated 11^th June xxx regarding the alleged delay on the Wooden Doors work where you are imposing a delay penalty to xxx Interiors, please be informed that your application of delay penalty is baseless and not acceptable due to the following;

• We have sent you our letter reference xxx dated 20^th May xxx in response to your letter reference xxx dated 19^th May xxx highlighting the current site situation where it is not practical for our materials to be installed due to such situation mentioned in our letter.
• On the same letter of ours, we likewise informed you that our materials were already delivered on site since 5 months ago based on your instruction, however, there is no proper storage facilities with controlled environment has been provided, and our materials have been left inside the apartment were several activities by others is going on. 
• In addition, we have informed you on the same letter, our readiness to install the doors, provided that you take the full responsibility of any damages that may occur due to the above-mentioned site conditions, but instead of replying to our request, you are sending us penalty letters.
• xxx Interiors have experience losses on other blocks due to similar situations where we installed our materials and it was damaged by others due to unclear areas for us to carry out our work.

Having said the above, we regret to inform you that your application of delay penalty is hereby rejected and we reiterate our previous statement that any damages to our materials on site due to your non provision of proper storage area and the site condition will not be our responsibility and we reserve our rights to claim for additional cost and extension of time due to any required rectification work.

This is for your information and urgent action.
