Subject : Residential & Hotel Serviced Apartments drawings comments
Dear Sir,
We are writing to you with regards some comments received on the residential & hotel apartment shop drawings (appendix 1) along with a compliance sheet to these comments prepared and signed ATAT on 10 June xxxx (appendix 2) and we would like to record our position & response to each of these comments to avoid any ambiguity in the future.
- SSH comment à Support details not furnished in this drawing. Provide support details for piping. Wooden pieces are not acceptable.
- ATAT response à all supports shall be PUF type.
Xxxx reply:
The introduction of PUF support will be subject to additional cost, which will be forwarded for approval. Xxxx will proceed with procurement and installation of PUF support after approval of the additional cost.
- SSH comment à all service opening to be sealed with approved mastic.
- ATAT response à Xxxx to confirm the sealant brand and type used.
Xxxx reply:
The sealant used is Gyproc sealant and is approved under Material Submittal # 15107-ATNM-MSF ARC-00120 dated 25-08-2020. (Appendix 3)
- SSH comment à subject to approval of Material inspection (MIR)
- ATAT response à Noted.
Xxxx reply:
- For Free issue material which is not under the scope or responsibility of Xxxx, ATAT should provide Xxxx with a copy of MIR approvals for all such items before the start of production.
- For materials under the scope of Xxxx, we will raise MIR inspections in factory prior to start of production as requested. Xxxx will not proceed until such factory inspection is performed and MIR approval obtained.
- SSH comment à any approval indicated above is in principle only and does not relieve the contractor of its responsibilities under the contract.

Xxxx reply:
This comment is not accepted by Xxxx as it is not in accordance with the Terms of our Work Order.
We must remind you that in accordance with our Work Order No. xxx, Other Terms & Condition, (8) Inspection, clause (e): “all pods acceptance is subjected to the inspection and approval by the consultants in supplier’s factory.”
Accordingly, unconditional approval in factory is mandatory prior to delivery. No comment or modification shall be accepted after pods have been approved and delivered.
Moreover, procurement and production of pods cannot proceed without prior approval on design and materials. Any subsequent change after approval shall be subject to additional cost.
Please note that all the material for the Residential & Hotel Serviced Apartments have already been procured based on previous approvals, and we have completed since March xxxx the production of 14 mockups based on approved drawings and materials.
The cost impact of the new comments/changes will be communicated separately for your approval to allow us to start the procurement process of changed materials, as well as abortive works related to already completed pods.
We again remind you that Xxxx cannot proceed based on approval in principle. We are at your disposal to close any comment you may have however, all approvals shall be final and unconditional before start of procurement, production, and delivery.
