Dear Sir,

We acknowledged receipt of your letter reference xxx dated 11th February xxx regarding the above referred subject and your statement regarding the outstanding works for the villa, where you have instructed us to complete the works within 3 days otherwise you will appoint a third party on our behalf, which we totally refute and reject.

Please be informed that your statement is contrary to the terms and conditions of the Subcontract, whereby, due to the delay in releasing our due payment we are entitled to extension of time (please refer to Clause 8 – Article 3 which is self-explanatory). Moreover, in accordance with the contract, we have the right to suspend the work if we did not receive our certified payment within 60 days, but due to our commitment we did not suspend the works and continuously we are working at site despite the fact that the last payment we received for the project was on 3rd May xxx.

In view of the above, should you decide to appoint a third party, we totally reject any deduction that may be applied on our account and we reserve our contractual rights to claim for all the relevant costs that we have incurred in executing our contractual obligations as permitted by law.
