Subject: WICKER FURNITURE FOR FAMILY BLOCK AND OVER WATER VILLAS
Dear Sir,
With reference to our letter xxx dated January 7, xx and further to your letter sent to us via email on January 8, xxx, we would like to reply as follows:-
- We haven’t mentioned that wicker sample is not available in the market but rather we are referring to the approved wicker material.
- Samples we received on November 12, xxx (reference code VIRO 0014 and VIRO 0016) with transmittal no 311 has no indication whether it is approved in terms of color and quality neither in family block nor over water villas. Xxx(Name of the Sub-Contractor) assumed that these samples are meant for these areas. Furthermore, we received letter from you via email on December 25, xxx with attachment of new image of wicker sample mentioning only the color reference i.e. Virosurface basket weave color V20 dark mahogany with brushed finish and not the approval.
- The basis of our price for wicker furniture was based on original sample provided by the client with ref S20 weathered pearl wash for the whole project and not only for over water villa, which you confirmed only via email on January 8, xxx.
- During your meeting with our management on November xxx, we have requested you to give us the specific location/ areas of wicker sample you have provided as you are not yet sure about the materials and location. Moreover, you have promised that you will confirm to us once you finalized with the consultant/client.
- Again, during your meeting with our management on mid of December xxx you had provided us with a wicker sample (reference code VIRO 0026 Brushed finish) without mentioning the specific area where it should be used and without official approval.
- Till date we haven’t received any official approval of wicker sample.
- We refer to your notice of variation no. 3 dated November 27, xxx which states that the time adjustment for the variation/ changed order is 91 days duration which means that it will commence after the approval of samples
Therefore, with all the above, we are not be held responsible to any delays incurred.
This letter serves as notification that any result delay or disruption could result in us requiring reimbursement of additional time and related costs implication.
In the interim we request that your necessary action to be taken to resolve this delay, in order that this delay will be mitigated.
