Dear Sir,

We are in receipt of your letter reference xxx dated 27th July xxx regarding the alleged slow progress of subcontract works for the Carpentry & Joinery which we disagree.

Please be informed that we are installing the carcass only where the AC is operational as if we install the units where there is no controlled environment our materials will get damage, unless ASCON will take the responsibility for any additional cost in case of damages. It is a requirement to install the finished joinery to be installed in an A/C controlled environment that has humidity between 40-60% and temperature not exceeding 26 degrees centigrade.

The method of installation for the works is to assemble the materials and to shift it to the relevant rooms and this corresponds to 90% of the work, while the hanging of the cabinet will be upon completion of carcass installation.

With regards to the Kitchen Cabinets, they are being assembled in the Basement Floor which was provided to us by ASCON Team, based on your letter you are instructing us to vacate the Basement which we have no objection, however, you have to provide us a new area to place our materials prior to removing them from the Basement area.

Please note that there are areas where we cannot install the Kitchen Cabinet due to site conditions issue which we have raised already through RFI, however, we have not receive any positive feedback from your team, which is delaying the progress of works at site which is not in our control.

On the other note, we disagree on your statement that the completion date of the works as per the Work Order should have been in 30th June xxx, we would like to refer you to ASCON letter reference xxx dated 17th June xxx and to Xxx (Name of the Subcontractor) Interiors’ letter reference xxx dated 1st June xxx highlighting the proposed completion date of 20th July 2015, however, the aforesaid completion date is subject to receiving the approval of our submittals in 3 days period.

Furthermore, the continuous delay in providing a cleared area and a controlled environment will delay the progress of works on site as this issue is out of our control and shall not held Xxx (Name of the Subcontractor) Interiors responsible. Please be informed that any penalty or liquidated damages that will be imposed by ASCON on Xxx (Name of the Subcontractor) Interiors will not be accepted, we reserve our rights to claim for extension of time due to the unavailability of the areas (refer to attached photos) and the unavailability of controlled environment where the joinery works shall be properly installed.
