Subject:                Shortage of Free Issue Materials – Tanks

Dear Sir,

This is to notify you that we have still not received from XXXX the free issue material SW-17A (small tanks) required to complete our scope.

Based on the instruction received on 19th October via Email (appendix 1) Xxxx should install the SW-17A (small tanks) instead of the SW-17 (big tanks). Based on this instruction, and to complete the project, a total of 188 No. of SW-17A (Small tanks) should be delivered by XXXX to our factory.

On the 3rd of November, we have received an Email (appendix 2) informing us that the total quantity will be delivered in one time. However, till date and despite our numerous follow ups (appendix 3), we haven’t received a clear date for the delivery of the tanks. We expect to run out from the current available materials within a maximum period of 2 weeks from now and if Xxxx does not receive these units from XXXX our production will be disrupted.

As per the sequence of pods deliveries received via Email on 24th November 2020 (appendix 4), we have already delivered pods for C2 L17, L23 and currently delivering for C2 L30. The SW-17A tanks available in our store will be enough only to complete C2 L30, C2 L38 and 13 pods of C1 L35.

In accordance with our Sub-Contract Agreement, Appendix 2, scope of work, item 2, Free Issue Materials must be selected, inspected, procured and then delivered to our factory by the Main Contractor.

Furthermore, we would like to highlight that the installation of these tanks are an early activity in the POD fabrication process and their installation must be performed in factory to allow major subsequent production activities to take place. These works cannot be performed on site.

We urge you to treat this matter on an urgent basis and provide us with the materials within the coming 2 weeks to avoid the disruption of production and delay in deliveries.

Xxxx shall not be responsible for any impact or consequence of the above delay in receiving free issue materials.
