Dear Sir,

We are writing in response to your letter ref: xxx dated 8th February xxxx regarding a schedule to close the MIR comments and would like to inform the following:

The main reason behind the rejection of the referenced MIRs is the approval of the marble which is preventing us from securing approval on the PODs since November xxxx. We have raised our concern on the marble approval on multiple occasions and we refer to our previous letters ref (c) & (d) which have been issued to this effect.

After having exerted all efforts and after having checked with both the project specified vendor list and more than 180 suppliers (photos and available quantities have been shared for more than 80 suppliers) for material which could meet the engineer’s satisfaction all without success, we have requested on 10 February xxxx for a High Management level meeting to address this issue and find a resolution and a way forward.

On 11 February xxxx, you have instructed us to submit 5 new marble samples to submit to the employer in preparation to the meeting, which we have immediately procured and subsequently delivered to your site on 17 February xxxx.

It has now been more than three weeks since we requested the high-level meeting on such an important subject, and we still have no feedback whatsoever on when this meeting will be held or whether any of the submitted samples or suppliers is deemed acceptable.

M/s xxx (Contractor Name) is faced with an impossible situation where none of the marble available in the market meets the current requirement of the Engineer. And unless and until there is a high-level discussion with the Employer with the intent to resolve this situation, the comments on the marble in the above MIRs will remain an issue.

Under the circumstances above, M/s xxx (Contractor Name) is not able to submit any realistic program as we have no basis or understanding on which to build such a program.

We urge you again to set a meeting with the Employer and the Engineer on an urgent basis to discuss the marble issues or provide us with the reference of any supplier which has the marble slabs that you deem acceptable to allow us to move forward.

Accordingly, M/s xxx (Contractor Name) will not be held liable for the impact of the above on the works, or for any direct or indirect impact on the site progress.
