Dear Sir,

We reject the content of your letter reference: xxx dated 6 May xxxx and the claim that (Contractor Name) in is delay in attending the Employer’s representative’s/Customer care snags.

We were informed following the receipt of this letter that the same letter content was issued to multiple subcontractors who are involved in the project, therefore, as of (Contractor Name), we would like to bring to your attention that all the pods left the factory already snags free and were installed and approved by the Engineer. Also all the comments issued on the WIR’s and MIR’s were immediately addressed upon receipt.

However, as you are aware, due to the work of your other trades subcontractors on site inside and around the pods and the testing and commission that was occurring, a lot of damages were caused to the pods which we are not responsible for and which led to additional work required. The damages were previously highlighted to you and were mutually checked with your respective team on site.  The damages reports were signed by your team and accordingly we have rectified these damages after we received clearance to start the work upon the completion of the other subcontractors work inside the pod to avoid rework and further damages.

Currently we are finishing the paint touch up for the ceiling access panel and installation of bathtub access tile which was kept till last to avoid damages. We have been notified that the buildings 1 and 2 are required to be handed over by 15 May xxxx which is an achievable date and our team is working closely to complete all the damages rectifications and touchups for these 2 buildings before 12 May xxxx. In case of not completing by 12 May, our team will be working during holiday to ensure the work is completed.

We urge you to secure the pods and not allow any further works or access inside the pods from your other subcontractors as this will risk again damages to the works which we cannot not be held liable for.

Our team is at your disposal to support, and we kindly request you to discuss with us in the future prior sending such notice to allow us to clarify the situation properly.
