Subject :     Response to Notice of delay in finalizing walls & floor tiles.

Dear Sir,

We are in receipt of your letter ref: xxx dated 02 August xxx and we would like to clarify the following:

On 12 July xxx we forwarded to you the suppliers letter confirming the variances in the tile shade/dimension which may be expected between different batches of production (appendix 1).

On 15 July xxx we have attended a meeting with ASC and the Engineer in which we have been advised to provide a tile that is similar to the tiles used in previous phases.

Accordingly, we have placed the order based on the phase 3 approved sample.

With regards to the tile sample submittal, It was our understanding that no sample was required based on the discussions in the meeting on 15 July xxx and based on the following comment on the tile submittal “No sample is required, follow previous phases”

During further discussion, we have been made aware that a sample was required irrespective of the above and we accordingly immediately delivered this sample to your site on 02 August xxx (appendix 2)

We have to remind you that while we will do all what we can to ensure that the tiles received will be within the range of previous phases, these tiles are not available locally and we await a fresh batch of production in India. We therefore do not have the ability to fully control the production quality and consistency of such an oversea manufacture and we are limited by the variances stated in the supplier’s letter above.

A sample of this new batch of production will be submitted to you as soon as it is made available by the supplier.
