Subject :              Response to notice of delay in Engineering Works

Dear Sir,

We are in receipt of your letter xxx dated 08 December xxx, and we record hereafter our official response.

While we recognize that this letter is not issued specifically to M/s xxx (Contractor Name) but is a general letter issued by the Main Contractor to all sub-contractors, we categorically reject the allegations made in this letter where they pertain to M/s xxx (Contractor Name).

Firstly, M/s xxx (Contractor Name) is not “far behind” the Engineering works milestone. Our engineering submittals have been concluded months ago. Pod production was started in the month of August xxx and we have currently delivered around 30% of pods under our Scope of Works.

Secondly, M/s xxx (Contractor Name) engineering submittals have been released in accordance with the submitted programme of works, all engineering submittals of M/s xxx (Contractor Name) have been approved before start of pod production and in accordance with the submitted programme of works.

We further remind the Main Contractor that M/s xxx (Contractor Name) extended its support by releasing engineering submittals ahead of schedule and prior to the Commencement Date of our Subcontract Agreement.

Finally, in due consideration of the above, M/s xxx (Contractor Name) categorically rejects your notice of delay and hereby requests that the Main Contractor withdraws his letter from transmittal records to M/s xxx (Contractor Name).
