Dear Sir,
We are extremely surprised to receive your notice of delay letter ref: xxx dated 23 May xxx which is completely misrepresentative of the actual facts.
The statement made by M/s xxx (Contractor Name) in the referenced Email is that after Eid, an “average” of 6 pods per day will be delivered to site, which would lead to an earlier expected completion date for deliveries on 01 July xxx as you have requested. The emphasis is on the word average since the delivery is entirely dependent on the readiness of your site to receive the pods.
As of the date of this letter, we have delivered to your site 86 pods, 80 of which have been offloaded in levels 1 and 2 completing these two floors. The remaining 6 pods which are for level 3, are on site for the last 3 days awaiting the erection of the loading platform of level 3, which as of 30 May xxx remained fully propped and unable to receive pods (appendix A).
We remain committed to completing deliveries by your requested date of 01 July xxx, however the rate of deliveries per day will depend on your site readiness. An average rate of 6 pods per day remains feasible to achieve the target date if the floors are open and platforms are available.
We attach for your information images of completed pods in factory which are awaiting the site to be ready for delivery (appendix B).
We categorically reject your notice of delay. M/s xxx (Contractor Name) is currently on schedule both in terms of production and delivery, and ahead of the site progress as clearly demonstrated above.
