Dear Mr. Neel,

We refer to your letter Ref: xxx dated 10th of October xxxx and the subsequent discussions during our meeting on Sunday, the 13th of October xxxx.  Please find below our comments and proposal.

  1. Program
  2. The program you have sent to us shows a start of delivery on 17th of October xxxx.  This date is not realistically achievable.
  • Procurement
  • As we wrote to you and explained on many occasions, there is a lead time for material procurement of about 10 weeks.  Please refer to our letter Ref: UP-1714 / LET-898-19 / BM-lc dated 30th of September xxxx in this regard.  The same was highlighted under our letters Ref: UP-1714 / LET-887-19 / GJ-at dated 22nd of September xxxx, Ref: UP-1714 / LET-865-19 / BM-lc dated 5th of August xxxx, and all previous correspondence and meetings.
  • Expected delivery of material (except tiles)
  • Upon receiving the Subcontract Agreement on 24th of September xxxx, and the instruction to proceed with procurement of items subject to design change on 23rd of September xxxx, (Contractor Name) placed orders and made the necessary payments to the suppliers in the subsequent 10 days.
  • Accordingly, we expect to receive the necessary material to complete pods (except tiles) by the 2nd week of December xxxx.
  • New nominated supplier
  • We received a new nominated supplier on 28th of September xxxx.  We made the necessary submittal on 7th of October xxxx.
  • We are waiting for the approval and green light to place the order to the nominated supplier.
  • As per the confirmation of your nominated supplier, the delivery is expected within 10 weeks from order and payment (please refer to the attached correspondence received from the supplier).
  • If we assume that the material approval will be received on Monday, 21st of October xxxx, it means we will receive the tiles by the 1st week of January xxxx.
  • Start of production
  • Based on the above, we anticipate the production to start beginning of January xxxx, assuming we place the order for tiles by Monday, 21st of October xxxx (any delay in approving the tiles will push this date forward by equivalent period).
  • Delivery schedule
  • Based on the above, we propose the attached delivery schedule based on the assumption that the tile approval and order will be done on Monday, 21st of October xxxx.
  • We have tried .to compress the schedule in order to assist you catch up on the finish date, however, it is impossible to finish deliveries by February xxxx.
