Dear Sir,

In response to your letter ref: xxx dated 2nd May xxx received on 4th May xxx, we would like to inform that we raised the marble matter at this stage due to the following:

  1. Multiple rejections to xxx materials during the inspections mentioned in your letter.
  2. The supplier refusal to replace the rejected materials despite our continuous requests and follow-ups and the letter ref: xxx dated 26 April xxx received from xxx stating that they have done all the possible options and requesting to approve the rejected sets.
  3. xxx being a Nominated Supplier, and the inability of (Contractor Name) to change it or seek alternative before obtaining a confirmation from Contractor/Engineer.

For that and since xxx left us with only one option which was to approve the rejected materials, we suggested another option which is to replace xxx and seek approval from an alternative supplier.

Should the Contractor finds any other suitable option that can resolve the matter, (Contractor Name) would be glad to support and work accordingly.

Moreover, the inspection that was scheduled on 2nd of May at xxx factory was postponed until further notice by the consultant. We urge you to push the consultant to reschedule the inspection at the earliest, as our team is ready to complete the installation of all the sets within 2 days only.

(Contractor name) shall not be responsible for the delay caused by the failure of a Nominated Supplier under no circumstances.
