Subject:              Rejection to Notice of Deduction for pods alignment issue.

Dear Sir,

We are in receipt of your letter reference xxx dated 17 May xxx and we fully reject the content of your letter.

We must remind you that the pods are installed on site based on survey points provided to us by the Main Contractor surveyor and all installed pods are inspected against survey points and approved by the Engineer.

Please refer to the approved work inspection request (WIR) for each installed pod.

Any measurement other than to the communicated and approved survey points based on which the pods were installed and approved is categorically rejected.

Therefore, M/s xxx (Contractor Name) will not accept any arbitrary deduction whatsoever related to approved pods and we reserve our rights to take any action we deem necessary against you if you decide to apply such unfair deductions.

On the other hand, we remind you that you are in default on your Contractual obligation as February xxx certified progress payment amounting AED xxx (appendix 1) against IPA no. 5 (appendix 2) is overdue and we urge you to release the signed LC invoice on immediate basis without further delay.
