Reference: a) M/s xxx (Contractor Name) letter xxx dated 22 August xxx
Dear Sir,
We are in receipt of your letter ref: xxx dated 23 November xxx and we completely reject your allegations of any delay.
In fact, we are truly surprised to receive such accusations when the instruction to hold activities in Buildings 1 & 2 was issued to M/s xxx (Contractor Name) by your own site team.
Please refer to the Email attached (appendix 1) in which your verbal instruction to hold the work in Buildings 1 & 2 was recorded and on that basis our team started working only in Building 3.
We invite you to discuss with your team and request you to discuss with us in the future prior sending such notice to allow us to clarify the situation properly.
We again remind you that you remain in default of your contractual obligations as recorded in our letter ref: (a) and urge you to clear our overdue payment and release our delayed certification on immediate basis.
M/s xxx (Contractor Name) will not be liable for any consequences caused by your default on your contractual liabilities and we reserve our rights under the Terms of our Subcontract Agreement to claim for all the damages and loss your default has caused to M/s xxx (Contractor Name) in addition to an Extension of Time (EOT) equivalent to the same number of days by which the advance payment, L/C establishment, certification and progress payments are delayed.
