Subject :     Rejection of “DB live test” Testing & Commissioning at B5 level 5 – Incomplete

                     installation of bathrooms pods.

Dear Sir,

We are writing in response to your letter reference: xxx dated 29 July xxx with regards to the subject mentioned above and the point 3 of your subcontractor letter “incomplete installation of shaver socket and light fittings inside the bathroom Pods” and we would like to inform the following:

  1. Our pods installation is complete and approved without any missing items as wrongly stated in your subcontractor letter and your letter content.
  2. The photos shown for missing lights and shaver sockets are due to the stolen materials on site and damages to the pods that occurred from other subcontractors work on site inside and above the pods and the water leakages that occurred.

The damages were previously highlighted to you and were mutually checked with your respective team on site. 

  • 6 No. of shaver sockets are required to be supplied from your end to replace the damaged/stolen earlier installed ones.
  • All the damages/stolen lights were ordered further to your signature of stolen/damage reports and are expected to arrive in October xxx.

Accordingly, since our pods were installed without missing materials and since the damage to our materials was done due to your team and your other subcontractors work on site, we are not responsible by any way to the delay that occur due to damaging our pods and the lead time required to re-arrange the replacement materials.

We again urge you to secure the pods and not allow any further works or access inside the pods from your other subcontractors as this will risk again damages to the works which we cannot not be held liable for.

Should you find that arranging the materials by yourself is a more suitable way to expedite the replacement of it, please feel free to do so and we will reverse our claim for additional cost submitted in this regard.
