Dear Sir,
We are in receipt of your letter ref: xxx dated 23 September xxx and we completely reject your statement that our engagement has not been fulfilled.
Our team available at your site is sufficient to complete the required groove paint above the door and Xxxx will not accept any kind of back charge or deduction whatsoever related to this matter.
We remind you that you have ignored your contractual obligations and have been in flagrant default on your payments since xxx as recorded in letters reference above.
Once again, we refer to our letter: xxx dated 26 July 2022 and urge you to:
- Release our overdue payment amounting AED xxx against TAX Invoice LOC-2022-00012.
- Certify the balance amount of AED xxx to allow us to submit the respective TAX invoice.
If you maintain your refusal to acknowledge our rights, settle our payment and certify our balance work and if you decide to remain in your default, you shall be fully liable for any resulting consequence of your actions, and we will proceed to take any action we deem suitable against you.
We further reserve our right to suspend the execution of the Sub‐Contract Agreement until such time as you process our Tax Invoice issued against fully certified works in reference to Article 247 of the UAE Civil Code and/or to terminate the Sub‐Contract Agreement in view of your uncontested and unjustified default pursuant to Article 272 of the same Code.
In the same line, Xxxx will not be held liable for any direct or indirect impact on the site progress and work completion. These liabilities reside with XXXX.
