Dear Sir,
We are in receipt of your letter ref: xxx dated 29 August xxx and we completely reject the content of your letter and your false allegations of delay in submitting close out documents.
We refer to the above referenced letters & attached Emails (appendix 1) that clearly record that all close out documents under Xxx scope are submitted already.
In addition, we note below our point wise response to each of the comments falsely stated in your letter:
- As-built drawings:
As-built drawings are approved since 10 Feb xxx as the only comment received on our submitted as-built drawings is not related to Xxx (appendix 2). This was clearly clarified to you via Email dated 14 Feb xxx (appendix 3)
- O&M manual:
The O&M manual is resubmitted to you on 24 August xxx.
In this regard, we remind you that our first submission of O&M is dated 1 July xxx and it took 201 days to receive the 1st comments. (appendix 4)
Despite complying with the comments and resubmitting on 23 May xxx, it took again another 16 days to receive feedback which surprisingly included new comments. (appendix 5)
Again, we have resubmitted while complying one more time with all the comments received and it took 35 days to receive a feedback. (appendix 6)
Moreover, we have resubmitted while complying one more time with all the comments received and it took 20 days to receive a feedback. (appendix 7)
In conclusion, the O&M delay in approval is solely due to the excessive comments and the long duration of review which are not within the control of Xxx and are under no circumstances the responsibility of Xxx.
- Spare parts:
Not in Xxx scope.
- Preventive Maintenance:
Not in Xxx scope.
- Training to the Operators/end users:
Not in Xxx scope.
In addition, there are no comments whatsoever related to PODS or to any part of the scope of Xxx neither in the WIRs, QA/QC comments, or engineers & operators comments as highlighted earlier in our letter ref (e) and our emails dated 9 June xxx (appendix 8)
In conclusion, the close out documents related to our scope are submitted, all the works related to us are completed and no any action is pending on Xxx.
