 Dear Sir,

We are in receipt of your letter ref: xxx dated 25 May xxx regarding the compliance to programme for balance pods installation and we would like to note the following:

In terms of installation, as you know delivered Pods can only be installed and WIRs raised once M/s xxx (Contractor Name) obtains the necessary clearances from the Main Contractors’ Civil & MEP teams. Once the clearances are received, the pods installation is proceeding immediately therefore please provide us with a detailed schedule of these clearances to allow us to plan accordingly.

There are no delay whatsoever from M/s xxx (Contractor Name) in this regard and our coordination is limited to request and follow up the clearance which our team is doing on daily basis.

We do not agree with the programme that you have attached related to the delivery of pods for levels 33, 34, 35, 36 & 23 since it does not include your anticipated dates at which you will deliver the pending quantities of tiles to allow us to proceed with production.

As of today, levels 23 & 33 are ready to dispatch, and we will do so immediately once we receive information from your site team that the relevant floor is open for installation.

However, as we have repeatedly communicated to you both officially vial letters reference (d), (e), (f), and (g) above and verbally in our regular meeting or calls, production of Pods for levels 34, 35 & 36 can only resume once the pending quantity of free issue materials is delivered by the Main Contractor to our manufacturing facility.

Till date, the final quantity of tiles type TL-202, in addition to few other Free Issue materials have still not been delivered to our factory.

M/s xxx (Contractor Name) can only confirm the completion of the last 35 Pods of levels 34, 35 & 36 once all pending materials essential for the production process are received.

M/s xxx (Contractor Name) will not be responsible for any delay in the completion of deliveries of pods or any consequences resulting from such delay which is a direct result of the lack of availability of Free Issue tile material from the Main Contractor.

We further reserve our right to claim for an extension of time equal to the same number of days by which the delivery of the Main Contractor’s material is delayed.
