Dear Sir,

We are in receipt of your letter ref: xxx dated 28 August xxx and would like to refer to our previous letters and discussions and inform you the following:

Sequence of delivery of pods

We note the receipt of your revised programme for installation of pods, and we shall follow the listed sequence in terms of priority during our production. Please note moving forward, that any change of sequence during production will have a two weak lead time due to the cycle of production and will impact delivery schedule accordingly.

Production volume

With regards to the pod production volume and delivery, we take note of your revised programme which compresses the schedule and consequently requires an increase of the pod production volume.

Production volume is a factor of both availability of material, as well as production line allocation for each project in relation to factory capacity.

Please note that material orders have been placed and deliveries are expected from overseas therefore we will appraise you regularly on the arrival of long lead items that are essential to production. M/s xxx (Contractor Name) has no control over shipping durations and restrictions during the ongoing pandemic.

Installation of pods at site

Please note that installation of pods on site will depend upon site readiness and be provisional on obtaining the signed necessary clearances from the Main Contractors’ Civil & MEP teams.

Finally, we shall keep you appraised during the various stages on the status of materials including the delivery of the Contractor’s free issue materials to our factory.

We will continue to extend all our efforts to deliver pods to site in a time frame compatible with your revised site requirements as far as such efforts are within the capacity and availability of our factory production lines during the period of production for your project.

As previously communicated, M/s xxx (Contractor Name) has no responsibility towards the Contractor’s delays in releasing the subcontract agreement, and our assistance in the recovery of such delays are entirely dependent on the above prerequisites.

All rights are reserved.

Yours faithfully,

On behalf of M/s xxx (Contractor Name) LLC
