Dear Sir,
We are in receipt of your letter reference xxx dated 13th April xxx in relation to the Scope of Works of Xxx (Name of the Subcontractor) Interiors to the Tower R10, where you have stated that in the absence of Completion Certificate Xxx (Name of the Subcontractor) Interiors does not relieved of its obligations under the contract which we don’t disagree, however, such obligations is limited only to the scope of works.
As previously stated, as far as Xxx (Name of the Subcontractor) Interiors is concerned, we have completed our scope of works based on several instructions issued by your good self to us to complete our works, moreover, we would like to refer you to Clause 7.1, 7.2 and 7.4 where it is clearly stated in Clause 7.1 that our scope of works is based on approved Drawings, Specifications, BOQ and addendums issued by the Consultant. Moreover, Clause 7.4 clearly stated the requirement to submit the shop drawings for the scope of works within 7 days of signing the agreement which we already did long time ago.
Nonetheless, Clause 7.2 clearly states that the Subcontractor agrees to execute the works based on drawings, specifications, BOQ and addendums as provided by the First Party at the date of signing the Subcontract Agreement, hence, the statement made on your above referred letter is misleading.
Consequently, any additional work that will be awarded shall be discussed and agreed and our due payment on the work done shall be settled accordingly prior to commencing on the works.
