Subject :     Impact of delay in first in place pods inspection and in inspection approval.

Dear Sir,

We are writing to you with regards to the inspection of the first in place (14 No.) pods of the Residential & Hotel Apartment buildings and the delay in receiving the inspection result till date.

As you are aware, the pods inspection was scheduled for 11 July xxx and the pods were made ready since 10 July 2021 for the inspection.

The pods inspection was conducted on 01 August xxx and till date after 1 month from the pods readiness and initial inspection date, we still haven’t received the official result of the inspection.

In addition, there are 3 items (the solid surface, mirror cabinet and shelves pins) which material submittals were awaiting final approval during the inspection of the first in place pods which till date isn’t obtained.

Accordingly, the delay in conducting the inspection and the further delay in providing the approval is not allowing us from placing the necessary orders for the 3 materials mentioned above and from moving forward in production.

Based on your email confirmation (appendix 1) that the mockup inspection will be to check workmanship and finishes only, we have moved forward with few activities (pod bases, walls erections, ceiling, waterproofing and tiling). We cannot proceed with balance activities until we obtain the approval on the first in place pods.

Furthermore, please note that we have limitation in the factory on how many pods we can erect without starting completing pods and dispatching as it will block our entire factory space.

We must remind you that in accordance with our Work Order No. xxx, Other Terms & Condition, (8) Inspection, clause (e): “all pods acceptance is subjected to the inspection and approval by the consultants in supplier’s factory.”

In conclusion, we will continue to extend all our efforts to expedite production and deliveries to our utmost capacity but we will not be responsible under any circumstances for the above delays and its consequences on procurement, pods production and pods deliveries.

Therefore we urge you to provide us with the approvals required on urgent basis.

Yours faithfully,

On behalf of  xxx LLC
