Dear Sir,

We are writing following the receipt of new deliveries of Free Issue Item (tiles- TL-202) on 30 and 31 May xxx as per the attached delivery notes (Appendix A).

After checking the quality of the delivery of 230.40 sqm on 30 May xxx, we have observed that TL-202 tiles received are similar in quality to tiles received in previous batches during the course of our production and which have led to NCRs and SORs from the Engineer on pods delivered to site.

Accordingly, we have submitted for your inspection and approval the material inspection request ref: J256-UNP-ARC-MIR-013_00 on which you have responded that items will be inspected once installation of pods is completed (Appendix B).

However, with this recurrent concern on the quality of tiles (as detailed in our quality report QIR-LAVIE-033 Appendix C which we have prepared for tiles received on 30 May xxx), M/s xxx (Contractor Name) cannot proceed with Pod tiling and therefore complete pod production since this would again lead to the same comment by the Engineer on the Pods once installed.

If the Main Contractor persists that we continue to make use of these tiles despite our recurring observations on the color, fluctuation, chamfering, and other quality aspects detailed in our quality report, then you are requested to sign off on the attached report and confirm you instruction to proceed in writing. In such a case we also kindly request that you segregate these tiles and instruct us on which individual tile unit/pattern is to be used in each pod type.

It is our recommendation however that you replace your delivered tiles with material that meets the quality expectations recorded in the Engineer’s SORs and NCRs on the same issue in order for M/s xxx (Contractor Name) to complete the production of the last 35 pods for levels 34, 35 & 36 and reasonably secure their approval.

M/s xxx (Contractor Name) will not be responsible for any delay in the completion of deliveries of pods or any consequences resulting from lack of availability of approved Free Issue tile material from the Main Contractor.

M/s xxx (Contractor Name) will not be held responsible for any comment resulting from the ongoing quality shortcoming of the Free Issue materials, and in particular tiles, as no amount of installation workmanship can overcome such defects in the supplied materials.

We further reserve our right to claim for an extension of time equal to the same number of days by which the delivery of the Main Contractor’s material is delayed.
