Subject : Draft Warranty Certificates
Dear Sir,
We are in receipt of your letter ref: xxx dated 20 April xxx concerning the draft warranty certificates and we would like to respond point wise to the comments of the Engineer:
- Comment: M/s xxx (Contractor Name) warranty shall cover workmanship for all materials not only defects related to the structure.
M/s xxx (Contractor Name) response: The materials used in the pods are not manufactured by M/s xxx (Contractor Name) but procured from various approved manufacturers who are liable for their products quality & workmanship.
In these cases, the installation in the pods is performed by M/s xxx (Contractor Name) and this is covered under the Defects Liability Period (DLP) as per our Subcontract agreement for 1 year from Taking over Certificate (TOC).
- Comment: All warranties shall include starting date from TOC.
M/s xxx (Contractor Name) response: The warranty issued by M/s xxx (Contractor Name) starts from TOC.
The warranties from other suppliers/manufacturers are passed through M/s xxx (Contractor Name) on a back to back basis. While the large majority of the suppliers/manufacturers complied with this requirement and have agreed to provide their draft warranties from TOC, some approved suppliers initiate their warranties from delivery of their material and not from TOC.
In order to facilitate discussions with these suppliers/manufacturers in relation to the comment, we kindly request that you provide us with the tentative date of the TOC.
- Comment: All warranties to be addressed to client, Client representative, furthermore, Consultant, Main Contractor, and Subcontractor name to be mentioned.
M/s xxx (Contractor Name) response: Noted and complied.
- Comment: Missing warranties to be provided, e.g. grill, Marble, MR MDF, Veneer, etc.
M/s xxx (Contractor Name) response: With the exception ofveneer, MDF and marble, all warranties have been submitted as per the O&M Manual revised submittal issued on 26 April xxx (appendix 1).
We are attaching herewith (appendix 2) the letters/replies received from the veneer, MDF and marble suppliers related to the warranties on their products.
Kindly note that these letters refer to the material warranties only, the installation scope of these items is covered by M/s xxx (Contractor Name) under the Defects Liability Period as referenced in Point #1 above.
- Comment: Light Manufacture warranty to be from date of TOC.
M/s xxx (Contractor Name) response: Noted and complied.
- Comment: Shaver socket/wiring accessories warranty should be from manufacturer (Legrand) and from date of TOC.
M/s xxx (Contractor Name) response: Noted. Legrand warranty for shaver socket & Oman cable warranty for wires are submitted covering a period of 1 year from TOC.
M/s xxx (Contractor Name) has prepared and submitted the Operation & Maintenance manual rev.01 on 26 April xxx (appendix 1) which includes the draft warranties prepared as per our discussion with the Engineer on 11 March xxx and in line with the submittal of the previous phase 1 project as advised in this meeting.
We have noted that the Engineer’s letter xxx is dated 23 February xxx but was only shared with M/s xxx (Contractor Name) on 20 April xxx, therefore we kindly request that shorter periods be followed in forwarding such letters from the Engineer to M/s xxx (Contractor Name) to allow us to respond or take the necessary action.
We are looking forward to receiving the approval on the O&M and acceptance of the draft warranties.
We also kindly request that you approach the Engineer on an urgent basis with our reply since the review process is currently ongoing and this correspondence contains information that is essential to this review.
