Subject:            Amendment to the Contract

Dear Sir,

We refer to the contract reference xxx dated 20th September xxx, the amendment to the contract dated 9th November xxx (copy attached) which we have already signed and forwarded to xxx and to the subsequent meeting between xxx and Xxx (Name of the Subcontractor) Interiors held yesterday 8th December xxx regarding the scope of works for the above referred project, we would like to highlight the following points for your information and subsequent confirmation;

  1. xxx and Xxx (Name of the Subcontractor) Interiors agreed that the additional 150 Villas internal doors will now be executed by Xxx (Name of the Subcontractor) Interiors for a unit rate of AED 1,500 / per door.

2.   Additional 220 Villas external door will be executed by Xxx (Name of the Subcontractor) Interiors on top of the original 150 Villas external doors.

3.   To amend the payment terms to be 60% on materials delivered to site and not installed, 40% progress payment, Xxx (Name of the Subcontractor) Interiors will submit the Invoice every 25th of the month, accordingly, the payment due date will be after one month from the payment certificate date.

4.   Payment Certificate (Application) will be approved within 30 days from the date of submitting the Payment Application.

5.   If Xxx (Name of the Subcontractor) Interiors delay the submission of Payment Application, it will delay the payment due date.

6.   10% performance retention shall be applied on each interim payment application in lieu of the requirement for performance bank guarantee and it shall be released on completion of the works and issuance of completion certificate.

7. 10% retention will be applied on each interim payment application, which shall be released as follows; first 5% after initial handing over and second 5% after the defects liability period.

Moreover, the other conditions of the contract will remain valid and applicable.

Please confirm your agreement to the above mentioned highlighted points in order for us to proceed accordingly.
