Dear Sir,
We are in receipt of your letter ref: xxx dated 05 October xxx and the enclosed letter from the Engineer ref: xxx dated 03 October xxx and respond as follows.
At the outset, the Contractor’s start and finish dates referenced in the Engineer’s letter are not official dates communicated or agreed by M/s xxx (Contractor Name) in any official correspondence. Please note that M/s xxx (Contractor Name) shall not be, under any circumstance, liable for commitments made by other parties on its behalf.
Moreover, and in relation to the programme of delivery, kindly refer to our previous correspondences as referenced above, in particular pertaining to the recorded Contractor’s delays in releasing the Subcontract order to M/s xxx (Contractor Name) to a date almost two months beyond what is shown under the Contractor’s baseline programme.
With reference to the mentioned root cause of the delay, which the Engineer attributes to the late submission of the right materials for the POD finishing, and further delays to procurement, we can confirm that all the POD finishing materials have been submitted correctly as per the project requirement. We can also confirm that the procurement of material has been initiated upon the receipt of the Subcontract agreement from the Contractor.
We assure you as always that M/s xxx (Contractor Name) will continue to extend all possible support to the Contractor, including potentially increasing our rate of pod production once all procured material arrives to our factory.
The status of procured material has been officially communicated to you in our previous correspondence and we will appraise of any change in due course.
