Subject : Draft Warranty Certificates
Dear Sir,
We are in receipt of your letter ref: xxx dated 1 September xxx concerning the draft warranty certificates and we would like to note the following:
First, we note the Engineer’s acceptance to the draft warranties of SANIT, RAK CERAMIC & ALCAPLAST.
Second, the Engineer’s comment on CLADTECH draft warranty certificate to add the word “working” is noted and the same will be added on the original warranty.
Third, the only unaccepted warranty as per the Engineer is currently for OMAN Cables which the Engineer is requiring from TOC. For that, please note that OMAN Cable approval was provided to us by the Main Contractor and we followed accordingly. (Refer to Appendix 1)
The warranty is passed through M/s xxx (Contractor Name) on a back to back basis and the approved manufacturers OMAN Cable initiate the warranty from delivery of their material and not from TOC.
The initial provided warranty was only for 1 year which we managed to increase to 5 years from delivery but the Manufacturer is not accepting to provide the warranty from TOC. (Appendix 2)
Lastly, we bring to your attention that the Engineer is requesting for original warranties submission which can only be after closing any pending commercial issues such as receipt of final account certification and settlement of final payment.
Accordingly, we request you to discuss with the Engineer the cables warranty and issue to us the final account certification to allow us to submit the invoice, receive our payment and submit to you the original warranties.
