Dear Sir,

We are in receipt of your letter ref: xxx dated 21April xxx concerning the submission of O&M manual and we would like to note the following:

It is extremely surprising to receive such a correspondence from the Main Contractor when the preparation of the O&M is ongoing based on the coordination with the Main Contractor’s representative.

Your allegations of continuous inadequacy and poor performance are false and unfounded. Such general accusations are categorically rejected, and we urge the Main Contractor to refrain from resorting to such biased communication that do not take into consideration ongoing events.

Firstly, it was jointly agreed with the Main Contractor after the meeting with the Engineer on 11 March 2022 that M/s xxx (Contractor Name) shall incorporate points raised by the Engineer on the O&M submittal for the PDLM Phase 1 project and once the O&M submittal for that particular phase is subsequently approved by the Engineer, then the same will be incorporated in PDLM phase 3 submittals. This process was laid out by all parties to facilitate approval and avoid unnecessary resubmissions.

Secondly, the Engineer’s response on the O&M submittal of Phase 1 was received on 17 April xxx and M/s xxx (Contractor Name) has been actively coordinating with suppliers and manufacturers to prepare their draft warranties in a manner similar to phase 1 as per the agreement during our meeting on 11 March 2022.

Accordingly, we expect that the revised O&M of phase 3 will be submitted to the Main Contractor in the coming days.

We again assure you that M/s xxx (Contractor Name) will close out any pending documents in accordance with our earlier discussions and we urge you once more to approach the undersigned in a constructive manner to address any concerns you may have or clarify any ongoing process so as to avoid general correspondence that only serve to hinder collaboration.
