Dear Sir,

We acknowledge receipt of your letter dated 19 September xxxx ref: xxx with thanks and note the following:

Your assertion that “your confirmation [is guided towards] mitigating delays that have transpired on the project due to the delivery of PODS” does not reflect the amicable discussions and agreements reached by the Parties during their meeting of 13 September xxxx (which you have convened at your head office).

The past is now closed, and the way forward is now agreed. As such, we shall proceed on the basis that the allegations on delays – which we vehemently contest – are now moot.

We would be grateful if going forward no accusations that would take away from the Parties’ discussions which led to the finalization of the Programme of Works and guided a constructive way forward, are made.

Considering the above, we request you to provide us with your unequivocal and firm approval of the Programme of Works (as conveyed to you on 15 September xxxx) as being the mutually agreed Programme in accordance with our Subcontract Agreement by 23 September xxxx- close of business.

Should you fail to do so, then you will be leaving us with no other option than to maintain our final position as communicated to you in our letter xxx dated 3 September xxxx.
